We should get the Sixth Circuit’s decision in Buckeye v. IRS soon and its not hard to predict that First Choice Women’s Resource Center will be cited throughout, one way or another. The Supreme Court decided First Choice on the same day the parties in Buckeye argued their case. The IRS might have had a much harder time if First Choice had been issued a week earlier. The dicta in that case regarding donor privacy is so strong that it is more likely to be cited for that proposition than it is for standing, which is what the case was ostensibly about.
